In these Terms & Conditions (“Terms”), our App and Services are referred to as “Services.” Please read these Terms carefully because they govern your use of our Services.
The information presented on our App is educational in nature and provided only as general information on your quest for physical, emotional and spiritual well-being, and not medical or psychological advice. You agree to follow the instructions and advice accompanying any of the Services.
By purchasing a WOW subscription to use our Services, you knowingly, voluntarily, and intelligently assume all risks, including any adverse outcome that might result from your use of the App. You agree to forever fully release, indemnify, and hold harmless, WOW, its owners, directors, employees, practitioners, content creators, consultants, agents, representatives, and others associated with WOW from any claim or liability whatsoever and for any damage or injury whether personal, financial, emotional, psychological or otherwise, which you may incur arising at any time out of or in relation to your use of the App or Services. WOW also known as WOW Feel Good Now to sign up for our app by entering their number when they download our app on the App Store or Google Play. Text HELP for help. Text STOP to cancel. Message and Data rates may apply. Message frequency varies. By entering your number, you agree to receive mobile messages’ and/OR links to Privacy Policy and SMS Terms & Conditions. Carriers are not liable for any delays or undelivered messages.
By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services.
Eligibility
You represent that you are competent and able to understand the nature and consequences of using the Services and Content and that you are an adult under the laws of the state of your residence. If you are a parent or legal guardian, agreeing to the Terms for the benefit of a minor, be advised that you are fully responsible for the said minor’s use of any of the App, its Services and Content, including all financial charges and legal liability that said minor may incur.
Using the Services
Subscribers can select from a variety of options to create customised relaxation and self-empowerment sessions using the WOW app’s BEST model.
You understand and agree that the Services, Products and any other information you learn from WOW are not intended, designed, or implied to diagnose, prevent, or treat any condition or disease, to ascertain the state of your health, or to be a substitute for professional medical care. Not all activities described on the Services are suitable for everyone. Do not use the Services while driving, operating heavy machinery, or performing other tasks that require attention and concentration. You understand and agree that you are solely responsible for your use of the Services.
Payment
You can purchase a monthly or annual subscription to the App to use the Services.
When you purchase a subscription, we may ask you to supply information such as your credit card number, the expiration date of your credit card, address, email and phone number. You represent and warrant that you have the legal right to use your preferred payment method.
If you choose to initiate a paid subscription, you authorise us to provide your payment information to third-party service providers so we can complete your transaction and agree to pay the applicable fees and any taxes that WOW may charge your credit card or third-party payment processing account, including, but not limited to, your account with the app store or distribution platform. All payments made are non-refundable and non-transferable except as expressly provided in these Terms.
WOW reserves the right to not process or to cancel your order in certain circumstances, for example, if your credit card is declined or if we suspect the order is fraudulent.
Subscriptions Automatically Renew Until You Cancel & How to Cancel Your Subscription
For monthly or yearly subscriptions, at the beginning of the subscription, each such subscription renews automatically for an additional period equal in length to the expiring subscription term until you cancel it. You must cancel your monthly or yearly Subscription before it renews to avoid being billed for the next Subscription period.
WOW reserves the right to change its pricing terms for Subscriptions at any time. WOW will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply to an existing subscription already purchased. If you do not agree with the changes to WOW’s pricing terms, then you may choose not to renew your subscription.
Termination
We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you. You may cancel your Account at any time by sending an email to us at hello@wowfeelgoodnow.com. If you purchase a subscription via an App Provider, you should also cancel your Subscription with the App Provider directly. Upon any termination, discontinuation or cancellation of Services, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
Content Rights and Ownership
WOW owns all rights, titles, and interests, in and to the Services and Content, including intellectual property rights, and the copyrights therein. Except as expressly authorised, you may not copy, adapt, alter, reproduce, modify, retransmit, rent, lease, loan, sell, publish, distribute, disseminate, broadcast, communicate or make available to the public the Services or Content, in whole or in part, or create derivative works of the App, its Services or Content. You acknowledge that the Services and Content are protected by copyright, trademark, and other laws of Australia and foreign countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Services or Content.
Links to Third Party Websites or Resources
The Services and App may contain links to third-party websites or resources. We provide these links only as a convenience and are not responsible for the content, products or services on or available from those websites or resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from, your use of any third-party websites or resources.
Warranty Disclaimers
We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content.
Indemnity
You will indemnify and hold harmless WOW and its directors, employees, agents, practitioners and content creators from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Services or Content or (ii) your violation of these Terms.
Liability
You agree and understand the Agreement is intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law and that if any portion hereof is held invalid, it is agreed that the balance of the Agreement shall continue in full force and effect. The Agreement sets forth the sole and entire understanding of the parties hereto relating to the subject matter hereof. Any and all matters in dispute between the parties to the Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of the State of Queensland, Australia, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted.
Governing Law
These Terms and any action related thereto will be governed by the laws of the State of Queensland, Australia without regard to its conflict of law provisions.
Changes to Terms or Services
We may modify our Terms from time to time. If we do so, we’ll update the Terms on our website and on the App. Because our Services are evolving over time, we may change or discontinue all or any part of the Services, at any time and without notice. If you don’t agree to our updated terms, then you may no longer use the Services.
